Hoddy $1,000 Cash Giveaway – Terms and Conditions

  1. Promoter:

  2. Eligibility:
    • Open to Australian residents aged 18 and over at the time of entry.
    • Excludes employees, immediate family members of Hoddy Pty Ltd, or anyone involved in organizing or judging the giveaway.
    • Entrants must have a valid Australian bank account for prize payment.
  3. Competition Period:
    • Starts: 12:00 AM AEST, 15 April 2025.
    • Ends: 11:59 PM AEST, 31 May 2025.
    • Late or incomplete entries will not be accepted.
  4. How to Enter:
    • Standard Entry (1 entry): Download the Hoddy app (free on iOS/Android) and create one post on the Hoddy platform during the competition period.

    • Additional Entries (10 entries per action): Post a promotional shout-out for Hoddy on any public social media account (e.g., Instagram, TikTok, X) that includes the hashtag #HoddyGiveaway and tags @Hoddyapp Each shout-out must be unique (e.g., different content or posted on different days) and verifiable. There is no limit to the number of shout-outs per entrant.

    • Entry is free; no purchase required. Standard data/internet costs may apply.
    • Multiple entries are permitted as outlined above, but automated, bulk, or fraudulent entries (e.g., via bots or fake accounts) will be disqualified.
    • Entrants must comply with the terms of service of Hoddy and any social media platforms used.
  5. Prize:
    • One (1) prize of $1,000 AUD, awarded as a direct bank transfer to the winner’s nominated Australian bank account.
    • Total prize pool: $1,000 AUD.
    • Prize is non-transferable, non-exchangeable, and cannot be redeemed for other forms (e.g., gift cards).
    • If the prize is unavailable for reasons beyond the Promoter’s control, a comparable prize of equal or greater value may be substituted, subject to state regulations.
  6. Winner Selection:
    • This is a game of chance. One winner will be selected randomly from all eligible entries using an electronic random draw system approved by relevant state authorities (if required).
    • Draw date: 1 June 2025 at Hoddy HQ, Melbourne, VIC.
    • The Promoter’s decision is final, and no correspondence will be entered into.
  7. Winner Notification and Publication:
    • The winner will be notified via email (using the email linked to their Hoddy account) and direct message on the social media platform used for entry (if applicable) within two (2) business days of the draw.

    • The winner’s name and state will be published on the Hoddy app, Hoddy website www.hoddy.com, and @Hoddy.app social media accounts on 2 June 2025, remaining available for at least 30 days.

    • For Victoria compliance (prize >$1,000): The winner’s name will also be published on www.hoddy.com within 30 days of the draw.
  8. Claiming the Prize:
    • The winner must respond within fourteen (14) days of notification to claim the prize, providing valid bank details for the transfer.
    • If the prize remains unclaimed after fourteen (14) days, or the winner is ineligible, a redraw will occur on 15 June 2025 at the same location, with the new winner notified and published as above.
    • Prize will be transferred within twenty-eight (28) days of verification, subject to bank processing times.
  9. Privacy:
    • Personal information (e.g., name, email, social media handle) will be collected solely for the purpose of administering the giveaway and verifying entries, in accordance with the Privacy Act 1988 (Cth).
    • Entrants consent to their name and state being published if they win.
    • Data will be stored securely and not shared with third parties except as required to administer the giveaway (e.g., bank for prize transfer).

  10. Disqualification:
    • The Promoter reserves the right to disqualify entries that:

      • Are deemed offensive or inappropriate.
    • The Promoter may verify the authenticity of social media shout-outs (e.g., checking public visibility and tags).
  11. Liability and Disclaimers:
    • The Promoter is not liable for any loss, damage, or injury arising from participation or prize use, except as required by law.
    • The giveaway is not sponsored, endorsed, administered by, or associated with Instagram, TikTok, X, or any social media platform.
    • Entrants release social media platforms from liability related to the giveaway.
    • If the giveaway is disrupted (e.g., due to technical issues, unauthorized interference, or force majeure), the Promoter may suspend, modify, or cancel it, subject to state regulations.
  12. General:
    • The giveaway is subject to Australian Consumer Law and state/territory regulations. No permits are required for a $1,000 prize in any state/territory, but the Promoter will comply with all relevant laws (e.g., publishing winner in Victoria).
    • Entrants consent to their Hoddy posts or social media shout-outs being used by the Promoter for promotional purposes without further compensation, provided their name is credited.

    • Any changes to the giveaway will be notified via the Hoddy app and @Hoddy.app accounts.

    • Victoria: As the prize exceeds $1,000, the winner’s name and state will be published as outlined.

    • Excludes employees, officers, directors of Hoddy Inc., their immediate family (spouse, parents, siblings, children), household members, and anyone involved in the giveaway’s administration.
    • Void in Puerto Rico, U.S. territories, and where prohibited by law.
  3. Promotion Period:

    • Entries received outside this period are void.

    • Free Alternative Method of Entry (AMOE): Mail a 3×5 card with your full name, address, phone number, email, and date of birth to: Hoddy $1,000 Giveaway. Each card received by April 30, 2025, grants one entry. Limit one mailed entry per person. No photocopies or mechanically reproduced entries. Sponsor not responsible for lost, late, or misdirected mail.
    • General Rules: No purchase necessary. A purchase does not improve odds of winning. Odds depend on total entries. Multiple entries permitted as outlined, but automated, bulk, or fraudulent entries (e.g., bots, fake accounts) will be disqualified. Entries must comply with Hoddy’s and social media platforms’ terms. Standard data/internet costs may apply.
  5. Prize:
    • One (1) prize: $1,000 USD, awarded via check or electronic transfer to the winner’s U.S. bank account.
    • Total prize value: $1,000 USD.
    • Non-transferable, non-redeemable for other forms, and not substitutable except at Sponsor’s discretion (e.g., for a prize of equal/greater value if unavailable).
    • Winner is responsible for all taxes and fees associated with prize receipt/use. 
  6. Winner Selection:
    • This is a sweepstakes (game of chance). One winner will be randomly selected from all eligible entries on June 1, 2025, at Hoddy offices, Wilmington, DE], using a random number generator or similar method.
    • Sponsor’s decisions are final and binding.
  7. Winner Notification:
    • Winner will be notified by email (via their Hoddy account email) and/or direct message on the social media platform used for entry within two (2) business days of the draw.
    • Winner must respond within five (5) business days, providing a signed Declaration of Eligibility, Liability Release, and (if requested) Publicity Release, plus bank details for prize delivery. If the winner is a minor in their state, a parent/guardian must sign.
    • If unclaimed, ineligible, or documents are not returned, an alternate winner may be selected from remaining entries.

    • Winner’s name may be posted on the Hoddy app, www.hoddy.com, and @Hoddy.app social media on May 2, 2025, unless prohibited by law.

  8. Tax Compliance:
    • For prizes valued at $600 or more, the winner must provide their Social Security Number or Taxpayer ID for IRS Form 1099-MISC reporting. Failure to provide this disqualifies the winner, and an alternate may be selected.
    • Winner is solely responsible for federal, state, and local taxes on the prize.

      • Violate these rules, Hoddy’s terms, or social media platform policies.
      • Are incomplete, fraudulent, or infringe third-party rights (e.g., copyrighted content).
      • Are deemed offensive or inappropriate.
    • Sponsor may verify shout-outs for authenticity (e.g., public visibility, proper tags).
  12. Liability:
    • Sponsor, its affiliates, and agents are not liable for any loss, injury, or damage from participation or prize use, except as required by law.
    • Entrants release Instagram, TikTok, X, and other platforms from liability related to the giveaway.
    • Giveaway is not sponsored, endorsed, or administered by any social media platform.
  13. General Conditions:
    • Subject to federal, state, and local laws. Void where prohibited (e.g., outside the 50 U.S. states/DC).
    • If the giveaway is compromised (e.g., by hacking, technical errors), Sponsor may cancel, modify, or suspend it, awarding the prize from eligible entries received prior to the issue, subject to state approval.
    • Sponsor may disqualify anyone tampering with the entry process.
